Terms & Conditions MTB Sport
Article 1 Applicability
1.1 These terms and conditions (hereinafter Terms and Conditions) shall apply to all offers MTB Sport acting under the trade MTB Sport and shop.waterpoloworld.com, and all agreements with MTB Sport.
1.2 The acceptance of an offer, or placing an order implies that you accept the applicability of these Terms.
1.3 The provisions of these Terms may be waived, in which case the other provisions shall remain in effect in writing.
1.4 Any reference in these Conditions of (supply of) products this also includes the provision of services and activities of any kind.
1.5 The term 'Buyer’ means any natural or legal person in a contractual relationship to MTB Sport, by virtue of one of our purchase agreement or other agreement as well or legal us a sale or other agreement wishes to each individual to go. In particular, the term ‘Buyer’ includes the person on whose behalf and for whose account products are delivered.
1.6 MTB Sport is authorised to use a third party in the execution of an agreement with the buyer.
1.7 Where in these conditions and on the website the term ‘form(s)’ is mentioned incluse the forms as shown on our web pages and/or unchanged by the buyer printed copies thereof.
Article 2 Offers / agreements
2.1 Offers or quotations should be regarded as an invitation to the potential buyers to make an offer. MTB Sport is in no way be bound, unless clearly written and recorded. The acceptance of the invitation to make an offer by the potential buyer is an offer and leads only to a conclusion of an agreement if the other provisions of this Article are met.
2.2 All MTB Sport offers are without engagement and MTB Sport reserves the right to change the prices, especially when this is necessary due to (legal) regulations.
2.3 Special offers are only valid for the period as indicated in the offer. This listing is printed in a brochure or listed on the website relating to this special offer. These periods are always similar.
2.4 A personalised offer is valid for a period of two weeks, unless a different period is stated in the offer.
2.5 An offer from the potential buyer as mentioned in Article 2.1 shall be deemed to be made in one of the following conditions:
- The potential buyer has clearly indicated which product and/or service he/she wishes to receive.
- An offer by the buyer has been signed and received by MTB Sport in the case a personalised offer was made.
- The potential buyer has entered the details in the appropriate input on the screen of the website and the relevant data (filled order form) is electronically sent and received by MTB Sport.
2.6 An agreement is in principle established at the time an order is handed over to the buyer or, in the case of supply through the website is done by e-mail has been sent to the by the buyer specified email address.
2.7 MTB Sport is to refuse or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, MTB Sport acknowledges this within 5 working days after receiving the order.
2.8 Buyer and MTB Sport expressly agree that use of electronic communication constitute a valid contract is established once the conditions in Article 2.5, 2.6 and 2.7 have been met. In particular, the lack of a signature does not affect the binding nature of the offer and its acceptance. The electronic files of MTB Sport that as far as the law allows, as a presumption of proof.
2.9 Information, images, communications, by telephone or via e-mail and tasks etc. with respect to all items and the main characteristics of the products are made as accurately as possible. However MTB Sport does not guarantee that all offers on products are fully consistent with the information given in accordance etcetera. Deviations cannot give rise to compensation and /or dissolution.
Article 3 Prices
3.1 The prices for the products and services offered are in the Euros currency, including VAT and excluding handling and shipping taxes or other charges.
3.2 Special offers are only valid while stocks last.
3.3 The buyer must pay the price that MTB Sport has communicated in accordance with Article 2.6 of these Terms and Conditions. Apparent (manipulation) mistakes in the price, such as obvious inaccuracies, can also be corrected by MTB Sport following the conclusion of the agreement.
Article 4 Distance Selling Regulations
4.1 Under the Dutch Selling Regulations (Recht van retour), you reserve the right to return an order any time within 14 business days, beginning the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with Article 5.
Article 5 Returns and Refunds
14 Day Return Policy
5.1 MTB Sport offers a refund on most purchases if returned in the condition in which they were sold within 14 business days beginning on the day after you received the Products. The refund is only offered if the Products are not used and returned to MTB Sport in their original condition as described in Clause 5.2.
5.2 If you decide to return the products for any reason, they products must not be used and must be handled with extreme care while they are in your possession. The goods must be returned to MTB Sport intact, undamaged, with their original packaging and as soon as reasonably possible. You must not remove any of the security or other tags from the Product. When trying on items of clothing, please ensure you handle the product with care, do not use unnecessary force and that you are not wearing perfume / aftershave or a deodorant which may leave a scent or marks on the item. We will be unable to accept the return of any item where there is evidence that these instructions have not been followed.
Faulty or Incorrect Goods
5.3 If the item(s) you have received are faulty or if you have received an incorrect item to that which you ordered, please contact firstname.lastname@example.org
quoting your order reference number, your name and address, contact phone and details of the product as well as the reason for return, and whether you request a refund or a replacement. We will then advise on how to proceed with the return. Once we have received the item, we will inspect the item and issue you a refund or a replacement (as requested) if appropriate, subject to our confirmation of the fault.
5.4 If you wish to return your item from MTB Sport you may do so within 14 business days after delivery of your order by sending an email to email@example.com
including your order number, which item(s) you want to return and why you want to return it. You will then receive the necessary information in order to proceed with your return and getting your refund or replacement.
Article 6 Events outside our control
6.1 MTB Sport will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by any act, event, omission, non-happening, or accident outside our reasonable control, including (without limitation) industrial action, civil commotion, war, riot, terrorist act, fire, explosion, storm, flood, any natural disaster, impossibility of use of appropriate modes of transport, technological or communication problems (Force Majeure Event).
6.2 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
